1. Acceptance of Terms
By accessing, browsing, or using any portion of LandlordPass.com (the "Platform"), including any course modules, tools, calculators, templates, checklists, or downloadable materials, you ("User") agree to be legally bound by these Terms of Use ("Terms"). If you do not agree to these Terms in their entirety, you must immediately cease using this Platform.
These Terms apply to all visitors, students, registered users, and any third parties who interact with the Platform in any way.
2. About LandlordPass
LandlordPass.com is an educational platform created and operated by Jimmy Ng and 3PM Real Estate Services Inc., a licensed BC property management company with over 25 years of experience in the British Columbia rental market. The Platform provides a free 16-module course covering BC residential property management practices, based on the Residential Tenancy Act (RSBC 2002, c. 78).
3. Intellectual Property Rights
All content on this Platform — including but not limited to course text, video scripts, presentation slides, calculators, checklists, templates, tool outputs, module structures, logos, graphics, and the overall course architecture — is the exclusive intellectual property of Jimmy Ng / 3PM Real Estate Services Inc. and is protected under:
- Copyright Act (RSC 1985, c. C-42) — Canada
- Personal Information Protection Act (SBC 2003, c. 63) — British Columbia
- Applicable international copyright conventions including the Berne Convention
The name "LandlordPass", the course title "Successful Landlord Mindset", and all associated branding are proprietary marks of 3PM Real Estate Services Inc.
4. License Grant
LandlordPass grants you a limited, non-exclusive, non-transferable, revocable, personal license to access and use the Platform's content solely for your own personal, non-commercial educational purposes. This license does not include:
- The right to reproduce, copy, or distribute any content
- The right to create derivative works based on course materials
- The right to sublicense, sell, rent, or commercially exploit any content
- The right to use course content to create a competing educational product or service
5. Prohibited Uses
You expressly agree NOT to:
- Screen record, download, or copy any video, audio, or written course content
- Upload, share, or redistribute any course materials on other websites, platforms, social media, or file-sharing services
- Resell, sublicense, or monetize access to any course content
- Use course content to build or contribute to a competing educational platform or product
- Misrepresent the source of any course material or remove copyright notices
- Use automated tools, bots, or scrapers to extract content from the Platform
- Use course materials for AI model training, machine learning datasets, or large language model fine-tuning
- Print and distribute materials in bulk for workshops, seminars, or classroom use without prior written consent
6. Educational Disclaimer — Not Legal or Professional Advice
All content on LandlordPass.com is provided for general educational and informational purposes only. Nothing on this Platform constitutes, or is intended to constitute, legal advice, financial advice, tax advice, real estate advice, or professional services of any kind.
Specifically:
- Course content does not create a lawyer-client, accountant-client, or agent-client relationship
- BC tenancy laws change frequently — always verify current rules at the BC Residential Tenancy Branch (RTB)
- CRA tax guidance in Module 15 is general — consult a licensed accountant for your specific tax situation
- Template documents (e.g., addenda, inspection checklists) are starting points — consult a lawyer before use in complex tenancy situations
- RTB dispute strategy in Module 16 does not substitute for legal representation
LandlordPass.com and Jimmy Ng / 3PM Real Estate Services Inc. are not liable for decisions made or actions taken based on course content. Individual results will vary. Always seek qualified professional advice for your specific situation.
7. Limitation of Liability
To the maximum extent permitted by applicable law in British Columbia, Canada:
- LandlordPass.com, Jimmy Ng, and 3PM Real Estate Services Inc. shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, this Platform
- This includes but is not limited to: loss of rental income, property damage, RTB hearing losses, tenant disputes, tax penalties, or any financial loss
- Our total cumulative liability to any user, for any claim arising from use of the Platform, shall not exceed CAD $100 (or the fees paid by the user in the preceding 12 months, whichever is greater)
Some jurisdictions do not allow exclusion of certain warranties or limitation of liability — in such cases, liability is limited to the fullest extent permitted by law.
8. Content Accuracy & Updates
LandlordPass.com makes reasonable efforts to ensure all course content reflects current BC law and RTB procedures. However, we make no warranties, express or implied, that the content is complete, accurate, current, or error-free at all times.
BC's Residential Tenancy Act is subject to legislative amendment. Users are responsible for verifying that information is current before acting on it. LandlordPass publishes content updates periodically but does not guarantee real-time accuracy.
9. Third-Party Links & References
This Platform may reference or link to third-party websites including BC Government portals (rtb.gov.bc.ca), Canada Revenue Agency (cra.gc.ca), Equifax, credit bureaus, and other services. These links are provided for convenience only.
LandlordPass.com does not control, endorse, or assume responsibility for any third-party website, content, or services. Linking to government resources does not imply government endorsement of LandlordPass.com or its content.
10. AI & Automated Use Prohibition
You are expressly prohibited from using any content, text, data, tools, or outputs from LandlordPass.com to:
- Train, fine-tune, or improve any artificial intelligence or machine learning model
- Build AI-generated content based on LandlordPass course materials
- Include LandlordPass content in any automated scraping, crawling, or data mining operation
This prohibition applies to both commercial and non-commercial AI development activities. Violation constitutes copyright infringement and may result in legal action.
11. Termination of Access
LandlordPass.com reserves the right to suspend or permanently terminate your access to the Platform at any time, without notice, if we reasonably believe you have violated any provision of these Terms. Upon termination, your license to use all course content is immediately revoked.
12. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of the Platform shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Vancouver, British Columbia, under the rules of the BC Arbitration Act (SBC 2020, c. 2). You waive the right to participate in class-action proceedings against LandlordPass.com.
13. Changes to These Terms
LandlordPass.com reserves the right to update these Terms at any time. The "Effective Date" at the top of this page will reflect the most recent revision. Continued use of the Platform following any changes constitutes your acceptance of the revised Terms. We encourage users to review these Terms annually, particularly in January when BC tenancy legislation is frequently updated.
