The pattern most landlords miss

Late rent almost never starts as a crisis. It starts as "I'll have it Friday." Then Friday becomes next week, next week becomes a partial payment, and before long you are four months behind with no paper trail and no idea how to get the RTB to take you seriously.

In British Columbia, there is no grace period. Rent is late the moment it is not paid in full on the agreed date. The Residential Tenancy Act gives you a clear tool — the RTB-30 ten-day notice — but it only works if you use it early and consistently. Landlords who wait, or who accept partial payments without documenting them, often find themselves in a hearing with weak evidence and a frustrated arbitrator.

Payment methods — what works for both sides

Your tenancy agreement sets the payment method, due date, and amount (Module 7). Once signed, enforce it consistently. The best setup is a method that is automatic, traceable, and easy for both landlord and tenant.

BC law — RTA s.26(2)

If you accept cash, you must give the tenant a written receipt. No exceptions. It must be dated and signed, and you keep a copy. If you cannot issue receipts reliably, do not accept cash — the habit of taking cash without paper is one of the most expensive shortcuts in this business.

Late rent — the day-by-day response

When rent is late, respond quickly and consistently. The biggest mistake landlords make is waiting weeks to act, then trying to enforce rules they have been ignoring.

Day 1 (due date)
Rent is due. Check your account at end of day. If received, log it in the rent ledger — date, amount, method, reference number.
Day 2 (morning) — friendly reminder
Send a short, factual message: "Our records show rent for [Month] has not been received. Please send payment today and confirm with a reference number." Text is fine for speed, but follow up by email for the paper trail.
Day 2–3 — serve the RTB-30
Still unpaid? Serve the RTB-30: 10 Day Notice to End Tenancy for Unpaid Rent or Utilities. This is not the eviction — it starts the clock. The tenant has 5 days after receiving it to pay in full, which cancels the notice.
Day 3–7 — wait for payment or dispute
The tenant can (a) pay in full within 5 days, cancelling the notice, or (b) file a dispute with the RTB within 5 days. Check actively — call the RTB at 1-800-665-8779 near the deadline rather than assuming no news means no dispute.
After 5 days — no payment, no dispute
The notice takes effect on Day 10. You can then apply for an Order of Possession through the RTB. Do not change locks or remove belongings yourself — follow the RTB process.

Caution — consistency is your protection

Do not wait weeks before acting on unpaid rent. If you repeatedly accept late rent without serving RTB-30, you may weaken your enforcement position — the arbitrator may question why you suddenly started enforcing a rule you had been ignoring for months. Consistent, documented action is what wins hearings.

Partial payment — what happens

Accepting partial payment does not automatically cancel the RTB-30 — the notice requires payment in full within 5 days. The safest approach: accept the partial payment, note it in your ledger as "partial — $X of $Y received, RTB-30 remains active," and keep the notice alive for the balance. If the tenant pays the full outstanding amount within the 5-day window, the notice is cancelled regardless.

If this becomes a pattern, document every instance. Under RTA s.47 and Policy Guideline 38, a tenant who is repeatedly late — generally three or more times in a 12-month period — can be served a one-month notice for cause using the RTB-33.

Late fees — the $25 cap

You can only charge a late fee if it is written in the tenancy agreement, and the maximum is $25 per late payment (RTR s.7). You cannot charge a daily late fee, a percentage penalty, or an "admin fee" for processing late rent. If your clause exceeds the cap, it is unenforceable. Keep it simple: one flat fee of $25 or less, clearly stated.

Never do this

Do not change the locks, remove belongings, or shut off utilities to pressure a tenant into paying. These actions are illegal under the RTA and can result in significant orders against you at the RTB — regardless of how much rent is owed.

What goes wrong — real BC cases

Landlord wins at hearing, then loses on judicial review — over improper evidence service

In City2City Real Estate Services Inc. v Wang, 2024 BCSC 1267, the landlord had a dispute over unpaid rent at $6,120/month. The tenant submitted evidence — a WeChat translation — but did not serve it to the landlord before the hearing. The arbitrator admitted the evidence anyway and ruled against the landlord. The BC Supreme Court set the decision aside: the landlord was denied procedural fairness because he had no time to respond to the evidence or challenge the translation.

Lesson: You have the right to see all evidence in advance. If the other side submits documents at the hearing without proper service, object immediately and ask for an adjournment. Document everything you receive and when.
RTB · missed hearing

Tenant stopped paying, then won $57,700 — because the landlord was served at the wrong address

A BC tenant stopped paying $4,800/month rent in October 2022. The landlord issued an RTB-30 and the tenant did not contest it. After vacating, the tenant filed a dispute and served the landlord's hearing notice to the wrong address — the landlord missed the hearing entirely. The arbitrator awarded the absent tenant $57,700 (12 months' rent). Nearly two years later, the BC Supreme Court reversed the decision entirely, ordering the tenant to pay the landlord's legal costs and $3,500 in additional damages.

Lesson: If you miss an RTB hearing, apply for judicial review immediately. Keep your address on file with the RTB current, and always verify hearing dates directly with the RTB rather than relying on the other party.
RTB · withholding rent

Tenants withheld rent over a dispute — and still owed $7,000+ at hearing

Two tenants moved into a rental at $3,500/month in June 2023. They paid only $410 in August and nothing in September or October, claiming the unit was dirty and had broken appliances. The arbitrator confirmed that tenants in BC cannot withhold rent — even during an active dispute. They owed all unpaid rent regardless of their grievances about the unit's condition.

Lesson: Your tenants cannot withhold rent, even with valid complaints. Document the property's condition at move-in (Module 11). If a tenant stops paying, serve RTB-30 promptly — do not wait for the dispute to resolve itself.

Rent increases

For existing tenants, the only safe way to increase rent is with the official RTB-7 form, giving at least 3 full calendar months' notice, no more than once every 12 months. The 2026 maximum allowable increase is 2.3%. You cannot round up — calculate to the cent.

Important — notice timing

The 3 months does not include the month you serve the notice. If you serve the RTB-7 any time in January (even January 1), the three months are February, March, and April — so the earliest effective date is May 1. Serve in February and the increase starts June 1. Missing this rule is the most common reason increases are declared invalid.

Formula: New rent = current rent × 1.023. Calculate to the cent — do not round up. Serve RTB-7 at least 3 full calendar months before the effective date. (2026 cap confirmed by the BC government in August 2025 — verify the current year's figure before serving.)

On-time payment reporting

Rent reporting services report a tenant's payment history to the credit bureaus, helping tenants build credit through consistent on-time rent. For landlords it works as a soft incentive: tenants who know their payments are being reported are more motivated to pay on time. In Canada, services such as FrontLobby and Borrowell (Rent Advantage) offer this. Check terms and costs before enrolling, and tell the tenant their payments will be reported. It does not replace your legal remedies — you still serve RTB-30 for late rent — but it can reduce how often the problem arises.

Keep a rent ledger

A rent ledger is a running record of every payment — date due, date received, amount, method, reference number, notes — for the entire tenancy. At the RTB this is your primary evidence for late-rent patterns, partial payments, and payment disputes. The Tools tab has a ready-made template.

多数房东看漏的那个模式

迟租几乎从不以危机开场。它开场于"周五就给您"。然后周五变下周,下周变部分付款,等回过神已经欠了四个月,手上没有纸面记录,也不知道怎么让RTB认真对待。

在BC省,没有宽限期。约定日期没有全额付清,租金当场就算迟。《住宅租赁法》给了您一件清楚的工具——RTB-30十日通知——但它只在您用得早、用得一致时才有效。等着不动、或者收了部分付款却不留记录的房东,往往在听证会上证据薄弱、面对一位不耐烦的仲裁官。

收租方式——怎样对双方都好

租约设定付款方式、到期日和金额(第7单元)。签了就一致执行。最好的设置是:自动、可追溯、房东租客都省事。

方式怎么运作 & 为何排这个名次风险与说明
1预授权扣款(PAD)到期日自动从租客账户扣款。自动化最好——不用催,银行对银行有记录。租客随时可取消PAD。签署的PAD协议留档。资金不足可能产生NSF费用。
2e-Transfer(自动入账)租客转到您的邮箱;开了自动入账直接到账,无需密保问题。快、可追溯、小房东最实用。约定备注格式("Unit 4 — Jan 2026")。没开自动入账的转账可能过期失效。
3银行账单支付租客在网银把您加为收款方。可追溯,设成定期就自动。处理可能要1–2个工作日。核对收款方信息无误。

BC法律——RTA第26(2)条

收现金就必须给租客书面收据。没有例外。收据要有日期和签名,您自己留一份副本。开不了可靠收据就别收现金——"收现金不开条"的习惯,是这行里最贵的一条捷径。

迟租——逐日应对

租金迟了,回应要快、要一致。房东最大的错误是拖几周不动,然后想执行自己几个月来一直没管的规矩。

第1天(到期日)
租金到期。当天结束前查账。收到就记进租金台账——日期、金额、方式、参考号。
第2天(上午)——友好提醒
发一条简短、只讲事实的消息:"我们的记录显示[月份]租金尚未收到。请今日付款并回复参考号。"微信或短信图快可以,但要用邮件跟一遍,留下纸面记录。
第2–3天——送达RTB-30
仍未付?送达RTB-30:因欠租或欠水电终止租约的十日通知。这不是驱逐——它启动计时。租客在收到后5天内全额付清即可撤销该通知。
第3–7天——等付款或等争议
租客可以(a)5天内全额付清,通知作废;或(b)5天内向RTB提出争议。主动查——临近期限时打1-800-665-8779问RTB,别假设"没消息就是没争议"。
5天后——不付也不争议
通知在第10天生效。您可向RTB申请收回管有权命令(Order of Possession)。不要自己换锁或搬走物品——走RTB程序。

特别注意——一致性就是您的保护

欠租别拖几周才动。反复接受迟租却从不送RTB-30,可能削弱您的执行地位——仲裁官会问:您几个月都不管的规矩,为什么突然开始执行?一致、有记录的行动,才是听证会上取胜的东西。华人房东常见的"都是熟人/朋友介绍的,不好意思催",代价往往就是这个。

部分付款——会怎样

接受部分付款并不自动撤销RTB-30——通知要求5天内全额付清。最稳妥的做法:收下这笔部分付款,在台账记为"部分——应收$Y已收$X,RTB-30继续有效",通知对余额继续生效。租客若在5天窗口内把全部欠款付清,通知照样作废。

若这成了固定模式,每一次都记录。根据RTA第47条和政策指引38,反复迟付的租客——一般是12个月内三次或以上——可用RTB-33送达一个月的有因通知。

迟付费——$25上限

只有写进租约才能收迟付费,上限是每次迟付$25(RTR第7条)。不能按天收、不能按百分比罚、不能收处理迟租的"手续费"。条款超过上限即不可执行。写简单点:一笔$25或以下的固定费用,明确写清。

绝对不要这样做

不要为了逼租客付款而换锁、搬走物品或停水停电。这些行为在RTA下违法,无论欠了多少租金,都可能在RTB招来对您不利的重大命令。

房东听证会赢了,司法复核却翻盘——因为证据送达不合规

启示:错过RTB听证要立即申请司法复核。在RTB存档的地址保持更新,听证日期务必直接向RTB核实,不要依赖对方告知。
RTB · 扣着租金不付

租客因纠纷扣着租金不付——听证时仍欠$7,000以上

两位租客于2023年6月以月租$3,500入住。8月只付了$410,9月和10月分文未付,理由是房子脏、电器坏。仲裁官确认:BC的租客不得扣留租金——即使争议正在进行中。不管他们对房屋状况的不满是否属实,欠的租金一分不少。

启示:租客不能扣租,哪怕投诉有理。入住时把房屋状况记录好(第11单元)。租客一停付就及时送达RTB-30——别指望争议自己解决。

涨租

对现有租客,唯一稳妥的涨租方式是用官方RTB-7表,提前至少3个完整日历月通知,每12个月至多一次。2026年的最高允许涨幅是2.3%。不能向上取整——算到分。

重要——通知的时间计算

这3个月不含您送达通知的当月。1月里任何一天送达RTB-7(哪怕1月1日),三个月就是2月、3月、4月——最早生效日是5月1日。2月送达,则从6月1日起涨。算错这条,是涨租被判无效最常见的原因。

公式:新租金 = 当前租金 × 1.023。算到分——不要向上取整。生效日前至少3个完整日历月送达RTB-7。(2026年上限由BC省政府于2025年8月确认——送达前请核实当年数字。)

按时付款上报征信

租金上报服务把租客的付款记录报给征信机构,帮租客靠按时交租积累信用。对房东而言是一种柔性激励:知道付款会被上报的租客,更有动力按时付。加拿大有FrontLobby、Borrowell(Rent Advantage)等服务。参加前核对条款和费用,并告知租客其付款将被上报。它不替代法律手段——迟租照样送RTB-30——但能降低问题发生的频率。

Frequently asked questions常见问题

No. Rent is due on the date in the tenancy agreement — usually the 1st. If it's not received in full that day, it's late and you can issue RTB-30. The 5-day window after RTB-30 is served is the tenant's chance to pay and cancel the notice — it is not a grace period before the notice can be served.

The RTB-30 form states the notice may be given on any day after the rent was due, so same-day service is legally possible but may not be well received by an arbitrator. Most property managers send a reminder on Day 1–2 and serve on Day 2–3 — that's the professional standard.

Accepting partial payment does not automatically cancel the RTB-30 — it requires full payment within 5 days of receipt. Log it as "partial — $X of $Y received, RTB-30 remains active" and keep the notice alive for the balance. If they pay the full outstanding amount inside the 5-day window, the notice is cancelled.

Call the RTB at 1-800-665-8779 and ask if a dispute has been filed on your notice. Check your email including spam. If a dispute is filed, the RTB-30 is paused until the arbitrator decides — do not proceed with an Order of Possession while it's active.

No. The deposit cannot be applied to unpaid rent mid-tenancy without the tenant's written consent or an RTB order. It's held for end-of-tenancy claims (Module 8). Using it without authorization exposes you to a complaint.

No. Daily, percentage, and cumulative late fees are not permitted (RTR s.7). The maximum is a single flat fee of $25 per late payment, clearly stated in the tenancy agreement. Anything above $25, or any fee not in the agreement, is unenforceable.

No. Withholding rent is not permitted in BC in almost all circumstances, even where the landlord is in breach of repair obligations. The tenant must keep paying and file a dispute with the RTB to seek a remedy — as the case above shows, tenants who withhold are ordered to pay the full arrears anyway.

The general rule (RTA s.47, Policy Guideline 38) is at least three times within an unreasonably short period — typically three or more times in 12 months. Each instance must be documented. Use the RTB-33 for a one-month notice for cause. You don't need an RTB-30 for each instance, but serving them creates a much stronger paper trail.

RTB-30 is a 10-day notice for a specific instance of unpaid rent or utilities, cancellable if the tenant pays in full within 5 days. RTB-33 is a one-month notice for cause, used for a pattern of behaviour such as repeatedly late rent. RTB-33 cannot be cancelled by payment — the tenant must dispute it within 10 days or the tenancy ends.

No. It must be served by a method allowed under the RTA: in person, left at the unit, registered mail, or fax/email where the tenant agreed to that method in writing. Texting a photo is not valid service. Keep your proof of service — it's your evidence at any hearing (see Module 11's service table for deemed-received timing).

No. The 3 months are the three full calendar months after the month of service. Serve in January (even January 1) and the earliest effective date is May 1. Serve in February and it starts June 1. Getting this wrong can invalidate the entire increase.

Only through an Additional Rent Increase application to the RTB, which requires documented proof of extraordinary costs — not a common or easy path. You and the tenant can also mutually agree in writing to a different arrangement, but the tenant cannot be forced above the cap.

No. Rent cannot be increased during a fixed term — only once it converts to month-to-month or at a renewal, and only if 12 months have passed since rent was last set. When a fixed term converts automatically to month-to-month, you may serve the RTB-7 at that point subject to the 12-month rule.

Tenants can cancel PAD at any time through their bank. If it's cancelled and rent is missed, treat it as a late payment and run the day-by-day timeline — reminder on Day 2, RTB-30 by Day 3. Discuss an alternative method and document all communications.

Yes, if the method is set out in the tenancy agreement — both parties are bound by what's written. If the agreement doesn't specify a method, you're in a weaker position to refuse cash unilaterally. Get the payment method in writing from the start (Module 7).

NSF charges aren't capped the same way late fees are, but to recover them the fee must be clearly set out in the tenancy agreement and reflect your actual bank charge — not a punitive extra. Keep the bank's charge receipt in case it's contested. Better still, switch to PAD or e-Transfer and avoid the issue entirely.

Keep the rent ledger, receipts, every RTB notice served (RTB-7, RTB-30, RTB-33), proof of service, and written communications for at least 6–7 years after the tenancy ends — covering both the Limitation Act period and CRA's 6-year rental income requirement (Module 12's retention table).

接受部分付款不自动撤销RTB-30——它要求收到后5天内全额付清。记为"部分——应收$Y已收$X,RTB-30继续有效",通知对余额继续生效。若在5天窗口内把全部欠款付清,通知作废。

不可以。按天、按百分比、累计计算的迟付费均不允许(RTR第7条)。上限是每次迟付一笔$25的固定费用,且必须在租约中写明。超过$25、或租约里没写的费用,都不可执行。

不可以。在BC,几乎任何情况下都不允许扣租,即使房东违反了维修义务。租客必须继续付租,并向RTB提出争议寻求救济——如上文案例所示,扣租的租客照样被判付清全部欠款。

一般规则(RTA第47条、政策指引38)是在不合理的短期内至少三次——通常理解为12个月内三次或以上。每一次都要有记录。用RTB-33送达有因的一个月通知。不必每次都送RTB-30,但送了纸面证据链会强得多。

RTB-30是针对某一次欠租或欠水电的十日通知,租客5天内全额付清即可撤销。RTB-33是有因的一个月通知,用于反复迟付等行为模式。RTB-33不能靠付款撤销——租客须在10天内提出争议,否则租约终止。

不行。必须用RTA允许的方式送达:当面、留在单元、挂号信,或租客书面同意的传真/邮件。发一张通知的照片不构成有效送达。留好送达凭证——它是听证会上的证据(送达生效时间见第11单元的送达表)。

不含。这3个月是送达当月之后的三个完整日历月。1月送达(哪怕1月1日),最早生效日是5月1日;2月送达则从6月1日起。算错这条可能让整次涨租作废。

只有通过向RTB申请"额外涨租",且需提供非常规成本的书面证明——这条路既不常见也不容易。您和租客也可以书面另行约定,但不能强迫租客接受高于上限的涨幅。

不可以。固定期内不能涨租——只能在转为月租后或续约时涨,且须距上次定租金满12个月。固定期自动转月租时,可在该时点送达RTB-7,仍受12个月规则约束。

租客随时可通过银行取消PAD。一旦取消并漏付,就当作迟付按逐日流程处理——第2天提醒、第3天前送RTB-30。与租客商定替代方式,全部沟通留档。

可以,前提是租约里写明了付款方式——双方都受书面约定约束。租约若没写明方式,您单方面拒收现金的立场就弱得多。从一开始就把付款方式写进合同(第7单元)。

NSF费用不像迟付费那样被设上限,但要收回,费用必须在租约中写明,并反映您实际的银行收费——不能是惩罚性加价。保留银行的收费凭证以备争议。更好的办法是改用PAD或e-Transfer,从根上避免这个问题。

租金台账、收据、送达过的每份RTB通知(RTB-7、RTB-30、RTB-33)、送达凭证和书面沟通,租约结束后至少保存6–7年——同时覆盖《时效法》期限和CRA对租金收入6年的要求(见第12单元的保留表)。

Log the payment the day it arrives, not at month-end. A ledger filled in from memory after a dispute starts carries far less weight than one kept contemporaneously.款到当天就记,别攒到月底。争议发生后凭记忆补填的台账,分量远不如当时就记好的。

Short, factual, no accusation — send the morning after the due date, before any formal notice. Copies clean English (this goes to the tenant); Chinese mode shows the annotated version.简短、只讲事实、不指责——在到期日次日上午发送,早于任何正式通知。复制的是干净英文版(发给租客);中文模式显示带注释版。

Send by email even if you also text or WeChat — the email is the paper trail. Only mention the $25 fee if your tenancy agreement actually contains a late fee clause.即便同时发了短信或微信,也要发一封邮件——邮件才是纸面记录。只有租约确实写了迟付费条款,才提$25。
