Prevention first — most disputes are avoidable

The best landlord-tenant dispute is the one that never happens. Most RTB hearings exist because someone skipped a step, lost a document, or let a small problem grow. If you followed the earlier modules — proper screening (Module 6), a complete tenancy agreement (Module 7), thorough inspections (Module 11), a current rent ledger (Module 13), and documented communication (Module 12) — you already have what most landlords do not: audit-ready records.

This module covers what to do when prevention isn't enough: the full RTB process from problem to resolution, what representation actually costs at each phase, why settlement is usually the better financial outcome, and what the arbitrator is really looking for.

Common scenarios — which path do you follow?

Scenario 1 — Unpaid rent

Rent due on the 1st, not received by the 2nd. Send a reminder. Still unpaid on the 3rd — serve RTB-30 (10 Day Notice). The tenant has 5 days to pay in full, which cancels the notice. If they neither pay nor dispute, file an Application for Dispute Resolution and request an Order of Possession (Module 13 covers the timeline in detail).

Scenario 2 — Repeatedly late rent

The tenant has been late four times in twelve months, each one logged in your rent ledger. Serve RTB-33 (1 Month Notice for Cause). Unlike RTB-30, the tenant cannot cancel this by paying — they must dispute it or vacate. Your evidence is the ledger showing the pattern.

Scenario 3 — Damage at move-out

Complete the move-out inspection, compare it line by line against the move-in report and photos (Module 11), get a repair quote, and calculate the tenant's share using useful-life depreciation (Policy Guideline 40). Apply to retain part or all of the deposit within the 15-day window (Module 8). If the tenant disputes, the RTB decides on the evidence.

Scenario 4 — Landlord use

You or a close family member genuinely needs the unit. Serve RTB-32 (4 Month Notice for landlord's use of property — the notice period was extended from two months in 2024, and these notices must be generated through the RTB's online portal). You must act in good faith.

Caution — good faith is enforced

If you end a tenancy for landlord's use and then don't actually use the unit as stated — or don't do so within a reasonable time — the tenant can apply for compensation, and the RTB can order a substantial award measured in months of rent. There is also a minimum occupancy period once you do move in. Don't use this notice to replace a tenant with a higher-paying one; the arbitrator will look at what you actually did afterward. Verify the current notice period, compensation amount, and portal requirements with the RTB before serving.

The four phases of an RTB dispute

Each phase adds cost, time, and complexity. Understanding them is what lets you decide when to settle and when to proceed. Expand each phase for the tasks involved.

Before filing anything, your documents need to be audit-ready. A lawyer or advocate reviews the tenancy agreement, addendum, and rent ledger for RTA compliance, drafts the correct notice, and serves it properly with proof of service (RTB-34).

This is where the earlier modules pay for themselves. Complete agreement, current ledger, documented entries → the audit takes thirty minutes. Scattered records → your lawyer reconstructs your file at $200–$500 an hour.

2RTB filing & evidence management

File the Application for Dispute Resolution through the RTB portal and pay the filing fee. Then all evidence — photos, emails, inspection reports, rent records, communication logs — is organized into an indexed package, converted to accepted formats, and served on the other party by the deadline.

The evidence package is the most important part of your case. Arbitrators decide on documents, not on who speaks more persuasively. Serve it on time — evidence the other side hasn't received can be excluded, and as Module 13's City2City case showed, evidence admitted without proper service can get a whole decision overturned.

3Hearing preparation & advocacy

Your representative drafts a statement of facts and a chronological timeline, briefs any witnesses (contractor, neighbour, property manager), and attends the hearing. Hearings are typically by telephone conference, and waiting time is billable time.

The hearing is where your evidence package does the work. Your representative refers to evidence by tab number, walks the timeline, and answers questions. The stronger your records, the shorter and cheaper this phase.

4Enforcement & writ of possession

If the tenant doesn't comply with the order, you enforce it: serve the Order of Possession or Monetary Order, register it with the court, and if needed coordinate a court-authorized bailiff. You cannot change the locks yourself — not even holding an order.

Phase 4 is where costs escalate. Bailiff fees, court filing, and extra legal hours can push a straightforward eviction well past $5,000 — which is exactly why settling at Phase 1 or 2 is usually the cheaper path.

Legal fees in BC for landlord-tenant work typically run $200–$500 per hour depending on experience and location. Rates vary — confirm before engaging anyone.

Those are professional fees only. Add disbursements: the RTB filing fee, process server, court registration, bailiff, courier and copying. A full eviction through Phase 4 can reach $5,000–$10,000 all in — before counting the rent you weren't collecting throughout.

How legal billing works

Lawyers bill in six-minute increments (0.1 hours). A twelve-minute call is 0.2 hours — $70 at $350/hour. Most firms issue a statement of account itemizing each task by date, description, time, and amount, plus disbursements passed through at cost and GST on fees and taxable disbursements. Billing must be reasonable under the BC Code of Professional Conduct.

Why settlement is usually better

Settlement is strategy, not weakness. A signed Mutual Agreement to End Tenancy (RTB-8) gets you the unit back on a known date without the cost and uncertainty of a hearing — and if the tenant breaks it, the agreement itself becomes evidence.

The math is plain. A settlement conversation at Phase 1 costs a few hundred dollars in legal time. A contested hearing through Phase 3 costs $1,600–$5,250. Even when you would have won, settling often produces the better outcome once you add the months of lost rent that the process consumes.

Key point

A landlord with good records who offers a fair settlement early almost always comes out ahead financially — even in a case they would have won. Good records don't just help you win hearings; they give you the credibility to settle on decent terms without one.

What the arbitrator looks for

The arbitrator isn't a judge — they're a neutral decision-maker applying the Residential Tenancy Act to the evidence in front of them. They're looking for:

  • Timeline compliance — the correct notice, with the correct notice period, and follow-up within the required deadlines.
  • Proper service — an accepted delivery method with proof (RTB-34), and deadlines counted from the deemed-received date, not the send date (Module 11).
  • Good faith — did you communicate, and give the tenant a chance to fix the problem before escalating?
  • Contemporaneous records — notes made at the time carry far more weight than a file assembled the night before the hearing. Your ledger, entry logs, and inspection reports are exactly this.
  • Organized evidence — an indexed package with a table of contents, numbered tabs, and chronological order signals that you take the process seriously.

常见情形——该走哪条路?

情形一:欠租

1号到期,2号还没到账。先发提醒。3号仍未付——送达RTB-30(十日通知)。租客有5天全额付清即可撤销通知。既不付也不提争议的,就提交仲裁申请并请求"收回管有权命令"(时间线详见第13单元)。

情形二:反复迟付

租客12个月内迟付四次,每次都记在租金台账里。送达RTB-33(有因的一个月通知)。与RTB-30不同,租客不能靠补付撤销——只能提出争议或搬走。您的证据就是显示这一模式的台账。

情形三:退房时的损坏

完成退房验房,与入住报告和照片逐行比对(第11单元),取得维修报价,按使用寿命折旧(政策指引40)算出租客应承担的份额。在15天窗口内申请扣留部分或全部押金(第8单元)。租客提出争议的,RTB依证据裁决。

情形四:房东自用

您或近亲属确实需要使用该单元。送达RTB-32(房东自用的四个月通知——通知期已于2024年由两个月延长,且此类通知须通过RTB网上系统生成)。您必须出于善意。

特别注意——"善意"是会被追究的

以房东自用为由终止租约后,若您并未按所述使用该单元、或未在合理时间内使用,租客可申请赔偿,RTB可判以月租计的可观赔偿金。您搬进去之后还有最短居住期的要求。不要用这份通知来换一个出价更高的租客——仲裁官会看您事后到底做了什么。送达前请向RTB核实当前的通知期、赔偿标准和网上系统要求。

RTB纠纷的四个阶段

证据包是整个案子最重要的部分。仲裁官依文件裁决,不看谁更会说。务必按时送达——对方没收到的证据可能被排除;正如第13单元的City2City一案所示,未经妥当送达却被采纳的证据,可以让整个裁决被推翻。

3听证准备与出庭代理

听证会上真正出力的是您的证据包。代理人按标签编号引用证据、走一遍时间线、回答提问。记录越扎实,这个阶段越短、越便宜。

租客不履行命令的,就要强制执行:送达收回管有权命令或金钱命令、到法院登记、必要时协调法院授权的执达员。您不能自己换锁——哪怕手里已经拿着命令。

第4阶段是成本失控的地方。执达员费、法院费用、额外律师工时,能把一次本来简单的收楼推到$5,000以上——这正是为什么在第1或第2阶段和解通常更省钱。

律师怎么计费

律师按6分钟为单位计费(0.1小时)。一通12分钟的电话是0.2小时——按$350/小时就是$70。多数律所会出具账单明细,逐项列明日期、事项、工时和金额,另加按成本转付的代垫费用,以及服务费和应税代垫费用上的GST。根据BC省《专业操守准则》,收费必须合理。

为什么和解通常更好

和解是策略,不是示弱。一份签署的终止租约共同协议(RTB-8)让您在确定日期拿回房子,省去听证的费用和不确定性——而且租客一旦违约,这份协议本身就是证据。

算术很直白。第1阶段的一次和解谈话,律师时间成本只是几百块。争到第3阶段的听证要花$1,600–$5,250。即使您本来会赢,把过程中损失的几个月租金加进去,和解往往结果更好。

仲裁官在看什么

  • 送达妥当——用了认可的送达方式并有凭证(RTB-34),且期限是从"视为送达"日而非发出日起算(第11单元)。
  • 善意——您有没有沟通?有没有给租客改正的机会才升级?
  • 当时的记录——事发当时做的记录,分量远大于听证前一晚整理出来的卷宗。您的台账、进入日志、验房报告正是前者。

Frequently asked questions常见问题

Yes — landlords can represent themselves, and for straightforward matters with clean records many do. But where the case involves significant money or a contested eviction, someone who knows RTB procedure can make a real difference. The cost of losing a case you should have won usually exceeds the fee.

No. You must go through court enforcement: register the order with the court, then a court-authorized bailiff carries out the physical lockout. Changing the locks yourself — even holding an order — can expose you to a claim, and undoes the position you just spent money to win.

They have the right to. Once a dispute is filed, the notice is effectively paused until the arbitrator decides. Do not proceed with enforcement while a dispute is active — wait for the written decision.

The Certificate of Service. After serving a notice, you complete it to prove when, where, and how the notice was delivered. It's needed when you file. Without it the arbitrator may question whether the tenant actually received the notice — and a good notice served badly is a lost case.

The RTB can award the filing fee and some dispute-related expenses, but it does not routinely order one party to pay the other's full legal costs. Budget on the assumption that your own fees are your own cost — which is another argument for settling early.

Your application may be dismissed and you start over — having lost the time. Wrong form, wrong notice period, or defective service are among the most common reasons landlords lose. This is exactly what Phase 1 exists to prevent.

Run the numbers. If a hearing through Phase 3 costs $3,000–$5,000 and a settlement at Phase 1 costs a fraction of that while getting the unit back two months sooner, settling is the better financial result even in a winning case. Add the lost rent during the process and it's usually not close.

Everything relevant, indexed: the signed tenancy agreement and addendum (Module 7), rent ledger (Module 13), inspection reports and photos (Module 11), entry logs (Module 12), communication records, repair records and invoices (Module 14), the notice you served, and the RTB-34. A table of contents with numbered tabs tells the arbitrator you're prepared before you say a word.

Yes — written communication is admissible regardless of platform. Preserve it properly: screenshots showing sender and date, exported where possible, and organized chronologically in your package. If the messages are in Chinese, provide a translation and serve it on the other party with the rest of your evidence, well before the hearing.

The arbitrator can decide without you, and the outcome can be severe (see the $57,700 case in Module 13). Confirm the hearing date and call-in details directly with the RTB rather than relying on the other party, keep your contact information current with the RTB, and if you do miss one through no fault of your own, seek review immediately — the deadlines for that are short.

Be careful here. Accepting a partial payment does not by itself cancel an RTB-30, but how you handle and describe it matters — document that it is accepted toward arrears without waiving the notice (Module 13). Refusing money you are owed rarely helps your position. Get advice before turning down payment as a tactic.

It varies with RTB scheduling and whether the tenant disputes. A straightforward unpaid-rent matter can move in weeks; a contested case with a dispute, a hearing, and enforcement can run months — during which you are usually not collecting rent. That time cost is the strongest argument for prevention and early settlement.

您的申请可能被驳回,只能从头再来——时间已经赔进去了。用错表、通知期不对、送达有瑕疵,是房东败诉最常见的几个原因。第1阶段的存在,就是为了防这个。

仲裁官可以在您缺席的情况下作出裁决,后果可能很严重(见第13单元$57,700那个案例)。听证日期和接入方式请直接向RTB核实,别依赖对方告知;在RTB存档的联系方式保持更新;万一非因己过错过了,立即申请复核——相关期限很短。

这里要谨慎。接受部分付款本身不撤销RTB-30,但您怎么处理和怎么表述很重要——记录清楚该款项计入欠款且不构成放弃通知(第13单元)。拒收本该属于您的钱,很少对您的立场有帮助。把拒收当策略之前,先咨询专业意见。

取决于RTB排期和租客是否提出争议。单纯的欠租事项可能几周内推进;有争议、要听证、还要执行的案子可能拖上数月——这期间您通常收不到租金。这段时间成本,正是"预防和尽早和解"最有力的理由。
