The two deposits BC law allows — and their hard caps

BC allows exactly two kinds of deposits, each capped at half of one month's rent:

  • Security deposit (RTA s. 19): maximum half a month's rent. If rent is $2,400, the maximum is $1,200.
  • Pet damage deposit (RTA s. 19): an additional maximum of half a month's rent, only if you permit pets. One pet deposit total — not per pet. Not chargeable for certified guide or service dogs.

That's the complete list. There is no "damage deposit" on top of a security deposit, no "cleaning deposit," no "key deposit" beyond direct replacement cost rules, no "move-out fee," and no last month's rent held as a deposit. If you collect more than the caps, the tenant can deduct the overpayment from rent (RTA s. 19(2)) — and the overcharge becomes evidence against you in any later dispute.

Timing: the deposit is payable when the tenancy agreement is formed. Under RTA s. 20, you cannot require a deposit at any other time, and if the tenant doesn't pay a required security deposit within 30 days of the date it's due, you may end the tenancy. Always issue a written receipt showing the amount, date, and what it's for.

Deposits you must NOT collect

Prohibited under RTA s. 15 and s. 20: application fees, "holding fees" before an agreement exists, cleaning fees collected up front, non-refundable anything, deposits above the half-month caps, and post-dated "damage cheques." The common overseas practice of collecting several months up front as "deposit" (押一付三) is illegal in BC — the deposit caps are absolute.

The 15-day rule: BC's most expensive deadline

When the tenancy ends, a clock starts. Under RTA s. 38(1), within 15 days of the later of (a) the date the tenancy ends, and (b) the date you receive the tenant's forwarding address in writing, you must do one of two things:

  1. Repay the deposit(s) plus applicable interest, or
  2. File a claim with the RTB against the deposit (application for dispute resolution).

Do neither within 15 days, and RTA s. 38(6) applies: you must pay the tenant double the deposit(s). Not "may" — must. Arbitrators have no discretion to waive the doubling penalty. It applies even when the tenant genuinely damaged the unit; you lose the right to simply keep the money the moment the deadline passes without repayment or a filed claim.

How this plays out

Typical scenario: tenant leaves the unit dirty with a damaged door. The landlord, feeling justified, keeps the $1,200 deposit and waits. The tenant applies to the RTB. Because the landlord neither returned the deposit nor filed a claim within 15 days of receiving the forwarding address, the arbitrator orders $2,400 paid to the tenant — and the landlord must now file a separate monetary claim for the damage, with photos and inspection reports, hoping to recover some of it. "The unit was damaged" is not a defence to the doubling penalty. The deadline is.

Practical notes on the clock:

  • The 15 days don't start until you have the forwarding address in writing — a text message or email counts if you can save it. Log the date you received it.
  • If the tenant doesn't provide a forwarding address within one year of the tenancy ending, the deposit is generally extinguished in your favour (s. 39) — but don't plan around this; most tenants provide it.
  • Interest on deposits is set by regulation and tracks the prime rate minus 4.5% — for recent years it has been a small but non-zero amount. Use the RTB's online deposit interest calculator for the exact figure and include it in the repayment.

Deductions: only two lawful paths

You may keep all or part of a deposit in exactly two situations (RTA s. 38(3)–(4)):

  1. The tenant agrees in writing to the specific deduction at the end of the tenancy — ideally on the move-out inspection report or the RTB's mutual agreement form. A verbal "yeah, that's fair" at the walkthrough is not consent you can rely on.
  2. The RTB orders it after you file a claim and win.

What deductions can legitimately cover: damage beyond reasonable wear and tear, unpaid rent or utilities the tenant owed, and cleaning only where the unit wasn't left reasonably clean. What they can't cover: repainting after normal ageing, worn carpet from ordinary use, or upgrading the unit at the outgoing tenant's expense. The standard is "reasonably clean and undamaged except for reasonable wear and tear" (RTA s. 37(2)).

Inspection reports: the key that keeps your claim alive

The deposit system is welded to the condition inspection reports covered in Module 11. Two facts matter here:

  • If you fail to conduct the move-in or move-out inspection and complete the report as required, your right to claim against the security deposit for damage is extinguished (RTA s. 24 and s. 36). The tenant's deposit must come back regardless of the unit's condition — you'd have to pursue damage as a separate monetary claim with weaker evidence.
  • The reports are also your evidence. A signed move-in report plus a signed move-out report showing the difference is what wins deduction claims at the RTB. Photos attached to both make it nearly airtight.

Housekeeping that keeps deposits clean

  • Keep deposits identifiable. You're holding the tenant's money in trust conceptually — best practice is a separate account or at minimum a ledger entry per tenancy, so the deposit plus interest is always payable on demand.
  • Receipt everything: deposit received, interest paid, deductions agreed. Every dollar that moves gets paper.
  • Key fobs and garage remotes: you may charge for replacing keys/fobs the tenant loses, at direct cost — but a refundable "key deposit" is only permitted where the fee doesn't exceed the direct replacement cost, and access devices required for the tenancy generally can't carry extra fees.
  • Deposit transfers on sale: if you sell the property, the deposit obligation follows the building — make sure the adjustment is handled in the sale and the tenant is told in writing who now holds their deposit.

BC法律只允许两种押金——上限是死的

BC省恰好允许两种押金,每种上限都是半个月租金

  • 保证金(RTA第19条):上限半个月租金。租金$2,400,上限就是$1,200。
  • 宠物损坏押金(RTA第19条):允许养宠时可另收,上限也是半个月租金。全部宠物合计一份——不是每只一份。有认证的导盲犬和服务犬不得收取。

就这两种,没有别的。没有保证金之外再来一份"损坏押金",没有"清洁押金",没有超出直接补配成本的"钥匙押金",没有"退房费",也不能把最后一个月租金当押金扣着。收超了上限,租客有权直接从租金里扣回多收部分(RTA第19(2)条)——而且超收本身会成为日后任何纠纷里对您不利的证据。

收取时点:押金在租约成立时支付。根据RTA第20条,不能在其他任何时点要求缴押金;租客在应缴之日起30天内未付保证金的,您可以终止租约。收到押金务必开具书面收据,写明金额、日期和用途。

绝对不能收的钱

RTA第15、20条明令禁止:申请费、租约成立前的"占位费"、预收清洁费、任何"不退还"款项、超过半月上限的押金、预开的"损坏支票"。国内常见的"押一付三"在BC省就是违法——押金上限是绝对的,几个月租金当押金收,每一分超收都站不住。

15天规则:BC省最贵的一个期限

租约一结束,倒计时就开始。根据RTA第38(1)条,在以下两个日期中较晚那个起的15天内——(a)租约结束日;(b)您收到租客书面转寄地址之日——您必须二选一:

  1. 退还押金(连同应付利息),或
  2. 向RTB提交针对押金的索赔(争议解决申请)。

15天内两样都没做?RTA第38(6)条生效:您必须双倍返还押金。不是"可能",是"必须"——仲裁员没有任何免除双倍罚则的裁量权。哪怕租客真的损坏了房子也一样:期限一过,您就失去了"直接扣着钱"的权利。

现实中怎么演的

典型剧本:租客走时房子很脏、门也坏了。房东觉得理直气壮,把$1,200押金扣下不动。租客申请RTB仲裁。因为房东在收到转寄地址后15天内既没退款也没立案,仲裁员判房东付租客$2,400——然后房东只能另行提起金钱索赔,拿着照片和验房报告去追损坏赔偿,能追回多少另说。"房子被弄坏了"不是双倍罚则的抗辩理由,期限才是全部。华人房东圈"押金先扣着,他要就让他来要"的习惯做法,正好撞在这条枪口上。

关于倒计时的实务要点:

  • 15天从您收到书面转寄地址才开始算——短信、微信、邮件都算书面,只要能保存。记下收到的日期。
  • 租约结束后一年内租客未提供转寄地址的,押金原则上归您(第39条)——但别指望这个,绝大多数租客都会提供。
  • 押金利息按法规设定,为基准利率减4.5%——近年是小额但不为零。用RTB官网的押金利息计算器算出准确数字,随退款一并支付。

扣押金:只有两条合法路

只有两种情形您可以留下全部或部分押金(RTA第38(3)–(4)条):

  1. 租客在租约结束时书面同意具体扣款——最好写在退房验房报告或RTB的双方同意表上。走场时口头一句"行吧,合理"不是可以依赖的同意。
  2. RTB裁决——您立案、开庭、胜诉之后。

扣款可以正当覆盖的:超出合理损耗的损坏、租客拖欠的租金或水电、以及房子没有保持基本清洁时的清洁费。不能覆盖的:正常老化后的重新刷漆、正常使用磨损的地毯、借退租之机给房子升级。法定标准是"基本清洁、除合理损耗外无损坏"(RTA第37(2)条)。

验房报告:保住索赔权的那把钥匙

押金制度和第11单元的验房报告是焊在一起的。这里有两个关键事实:

  • 没有按规定做入住或退房验房并完成报告,您就押金对损坏的索赔权直接消灭(RTA第24、36条)。无论房子什么状况,押金都得退——损坏只能另行金钱索赔,证据还弱了一截。
  • 报告同时是您的证据。签字的入住报告+签字的退房报告,两相对照的差异就是RTB扣款索赔的胜负手。两份报告都附照片,几乎无懈可击。

让押金账目永远干净的习惯

  • 押金专款可辨。您实质上是替租客保管这笔钱——最佳做法是单独账户,至少每份租约单独记账,保证押金加利息随时可退。
  • 一切开收据:收押金、付利息、约定扣款——每一块钱的流动都留纸面痕迹。现金收押金不开收据,是华人房东最常见也最吃亏的习惯。
  • 钥匙扣、车库遥控器:租客弄丢可按直接成本收补配费;可退还的"钥匙押金"只在不超过直接补配成本时允许,租约必需的门禁设备一般不得额外收费。
  • 卖房时押金随房走:出售物业时,押金义务跟着房子转移——在交易中处理好押金调整,并书面告知租客现在由谁保管。

要点回顾

Frequently asked questions常见问题

No. BC does not allow last month's rent to be held as a deposit. You may collect the security deposit (max half a month's rent) and, if pets are allowed, a pet damage deposit (max half a month's rent). Rent is payable when due — not in advance as a condition of tenancy.

A tenant may choose to pre-pay rent, but you cannot require it, and pre-paid rent is not a deposit — it's rent, credited to the months it covers. Be careful: large upfront payments are also a known fraud pattern (Module 1), and holding months of a tenant's money creates administrative risk. Best practice is standard monthly payment.

On the later of: the day the tenancy ends, or the day you receive the tenant's forwarding address in writing. If they hand you the address before moving out, the clock starts on the move-out date. If they email it two weeks after leaving, it starts on the day you receive the email. Log that date.

Not unilaterally. You need the tenant's written agreement to the deduction, or you must file an RTB claim within the 15 days. Keeping the deposit without either — even with real damage — triggers the doubling penalty under s. 38(6). File the claim; your inspection reports and photos are your case.

Deterioration from ordinary use over time: minor scuffs, faded paint, carpet wear in walking paths, small nail holes from pictures. Not wear and tear: broken doors, pet stains, burns, holes in walls, or grime requiring heavy cleaning. The move-in report is your baseline for the comparison.

Yes — interest accrues annually at the regulated rate (prime minus 4.5%). In low-rate years it was 0%, in recent years a small positive percentage. Use the RTB's online calculator with your actual dates; include the interest in the repayment or your figure is short.

Only within tight limits: a refundable fee not exceeding the direct replacement cost may be permissible for certain access devices, and you can charge actual replacement cost when a tenant loses keys/fobs. You cannot use "key deposits" to top up the security deposit beyond the half-month cap.

The deposit belongs to the tenancy, not to individuals — one security deposit per tenancy, capped at half a month's rent, regardless of how many co-tenants split it. When one co-tenant moves out mid-tenancy, deposit reshuffling is between the tenants; your obligation to return it arises when the tenancy itself ends.

If you offered the inspection properly — including the required second opportunity on the approved form — and the tenant failed to participate, the tenant's claim to the deposit can be extinguished (RTA s. 36(1)). But your paperwork must be perfect: proper notices, documented opportunities, completed report. Sloppy process flips the extinguishment onto you instead.

No — a tenant is not entitled to apply the deposit to rent (RTA s. 21). If they short-pay the final month saying "keep the deposit," that's unpaid rent, and you can claim it. Ironically, you must still follow the 15-day process for the deposit itself: return or file.

Deposit obligations run with the rental unit. Typically the deposit (plus accrued interest) is adjusted to the buyer on completion, and the buyer becomes responsible for returning it at tenancy end. Confirm the adjustment in the contract of sale and notify the tenant in writing of who holds their deposit.

Without a written forwarding address, your 15-day repayment clock hasn't started. If a year passes from the end of the tenancy with no address provided, the tenant's right to the deposit's return is extinguished (s. 39). You can still pursue unpaid rent through the RTB/courts if you can locate them for service.

不可以。BC不允许把末月租金当押金扣着。只能收保证金(上限半月租金),允许养宠的再收宠物押金(上限半月租金)。租金到期才付——不能把预付租金设为租约条件。

租客可以自愿预付,但您不能要求;预付的也不是押金——是租金,按月冲抵。要小心:大额预付本身是已知的诈骗模式(第1单元),替租客保管几个月的钱也带来管理风险。最佳做法就是正常按月收。

不能单方面扣。要么租客书面同意扣款,要么15天内向RTB立案。两样都没有就扣着——哪怕损坏是真的——第38(6)条双倍罚则照样落头上。去立案;您的验房报告和照片就是您的官司。

正常使用随时间产生的老化:轻微刮蹭、漆面褪色、走道地毯磨损、挂画的小钉孔。不算损耗的:门坏了、宠物污渍、烧痕、墙上的洞、需要重度清洁的污垢。对比的基准就是入住验房报告。

要。利息按法规利率(基准利率减4.5%)逐年累计。低利率年份是0%,近年是小额正数。用RTB在线计算器按实际日期算,退款时把利息算进去,否则金额就短了。

限制很严:某些门禁设备可收不超过直接补配成本的可退还费用;租客弄丢钥匙/门禁可按实际补配成本收费。但不能借"钥匙押金"变相突破保证金半月上限。

押金属于这份租约,不属于个人——每份租约一份保证金,上限半月租金,几个人分摊都一样。租期中一名合租者搬走,押金内部怎么调整是租客之间的事;您的退还义务在租约本身结束时才产生。

如果您按规定提供了验房机会——包括用规定表格给出的第二次机会——租客仍不参加,租客对押金的权利可以消灭(RTA第36(1)条)。但您的文书必须完美:合规通知、有记录的机会、完成的报告。流程马虎,消灭的就是您的权利。

不行——租客无权把押金抵作租金(RTA第21条)。最后一个月少付说"押金抵了",那就是欠租,您可以索赔。但讽刺的是:押金本身您仍要走15天流程——退还或立案,二选一。

押金义务跟着出租单元走。通常在成交时把押金(含累计利息)调整给买方,之后由买方在租约结束时负责退还。在买卖合同里确认这笔调整,并书面告知租客押金现在由谁保管。

没有书面转寄地址,您的15天退款倒计时就没开始。租约结束满一年仍无地址的,租客对押金的返还权消灭(第39条)。欠租仍可通过RTB/法院追讨——前提是能找到人送达。
